1. Who we are and what this covers
This policy explains how PortGate Nexus (“PortGate Nexus”, “we”, “us”) collects, uses, shares, stores and protects personal data when you visit our website, create an account, contact support or use our trade-compliance and logistics services.
We are the data controller for personal data used to run the platform. We process personal data in line with the Nigeria Data Protection Act 2023 (NDPA) and the Nigeria Data Protection Commission’s General Application and Implementation Directive 2025.
2. Information we collect
We only ask for what we need for the service you are using:
- Account details: first and last name, username, email address, an optional phone number, and your password (stored only as a secure hash).
- Business details you add during onboarding or in your profile, such as business name, address, registration and tax numbers, and business type.
- Trade and transaction information: product descriptions, HS codes, invoices, Form M and PAAR references, customs and shipping documents, supplier details and other files you upload.
- Financing requests: company name, contact email and phone, import value and currency, and the invoice and bill of lading you upload.
- Payment information: your name, email, phone number, amount, currency, plan and transaction reference. Card and bank details are entered directly with our payment provider, Payaza, and are not stored by us.
- Support and chat: messages you send through the chat assistant or live support, and, if you are not signed in, the name, email address and phone number you give so an officer can reply.
- Technical information: IP address, browser and device type, security logs, and the essential cookies and browser storage described in our Cookie Policy.
We do not use analytics, advertising or tracking tools on this website.
3. How we use information and our legal bases
- To provide the service you asked for (performance of a contract): creating and securing your account, compliance checks, HS-code suggestions, duty estimates, document review, transaction workflows, financing requests and support.
- To take payments and keep records (contract and legal obligation): processing subscriptions and per-container fees and keeping tax and accounting records.
- To send service messages (contract): verification, security, transaction and support emails. We do not send marketing emails unless you separately agree.
- To keep the platform safe (legitimate interests): preventing fraud and abuse, securing accounts, and fixing faults.
- To meet legal and regulatory duties (legal obligation): responding to lawful requests from customs, tax, financial and other authorities.
- To share your request with a partner (consent): when you ask us to pass a financing, insurance or storage request to a partner, we do so with your agreement, given when you submit the request.
Where we rely on consent, you can withdraw it at any time. This does not affect processing that already took place.
4. AI-assisted processing
We use automated and AI tools to suggest HS codes, read information from uploaded trade documents, flag possible compliance risks and answer questions in the chat assistant. To do this, relevant text from your documents or messages may be sent to our AI providers, Lightning AI and Google (Gemini).
AI outputs are advisory and can be wrong. A qualified person should review them before you rely on them for a customs declaration or another important decision. We do not make decisions with legal or similarly significant effects about you solely by automated means.
6. International transfers
Some of our providers, including our AI and email providers, process data outside Nigeria. When this happens we rely on the transfer grounds allowed by Part VIII of the NDPA, such as adequate protection in the destination country, appropriate contractual safeguards, or the transfer being necessary to provide the service you requested.
8. How long we keep information
We keep personal data only as long as we need it for the purposes above. Account data is kept while your account is open. Transaction, payment and trade records may be kept for longer where tax, customs, financial or other laws require it. Support conversations are kept for as long as needed to resolve the request and handle any follow-up.
When we no longer need information, we delete or anonymise it.
9. Security
We use access controls based on staff roles, secure password hashing, encryption in transit and other technical and organisational measures. No online service can guarantee complete security, so please keep your password private and tell us straight away if you suspect someone has accessed your account. If a personal data breach is likely to put your rights at risk, we will notify the Nigeria Data Protection Commission and, where required, you.
10. Your rights
Under the NDPA you can ask us to:
- give you a copy of your personal data and information about how we use it;
- correct inaccurate or incomplete data;
- delete your data, or restrict how we use it;
- give you your data in a commonly used, machine-readable format (data portability);
- stop processing based on our legitimate interests, or withdraw consent you have given;
- not be subject to a decision based solely on automated processing that significantly affects you.
Email support@portgatenexus.com to make a request. We may need to confirm your identity first. Some information may have to be kept where the law requires it. You can also complain to the Nigeria Data Protection Commission (opens in a new tab).
11. Children
PortGate Nexus is a business service for people aged 18 and over. We do not knowingly collect personal data from children.
12. Changes and contact
We may update this policy when the platform, our providers or the law change. We will tell you about important changes on the platform or by email, and the “Last updated” date above will change.
